Contract for the Breeding Season of
________ is made and entered into on this
_______ day of ________, 20____, is by and
between LUCKY ACRES QUARTER HORSES,
herein after designated Breeder, and
_________________________________________,
herein after designated Mare Owner. Mare Owner agrees to breed mare
named
__________________________________,
Registration Number __________________
to the stallion “JULES FOURTEEN KARAT,” AQHA Registration Number 3898967
for a Live Foal, subject to the following
conditions:__________________________

1.
Stallion Fee includes a non-refundable booking fee of $100.00, payable
with this contract. The balance of
which
must be paid with
all other expenses when mare is picked up or when Mare Owner is invoiced,
whichever is first. invoices are payable upon receipt. Mare Owner may not remove mare from
Breeder’s possession until all
expenses are paid in
full.
2.
Breeder
agrees to provide suitable facilities for the care and feed of the mare while in
their custody. Mare
Owner
agreed to pay for
care and feed at the rate of $_____ per day for Dry Mares and $_____per day for
Wet Mares.
3.
Breeder
will exercise judgment in the care and supervision of mare and/or foal. Breeder’s veterinarian
will
examine mare for
normal breeding conditions and will administer medical care as deemed necessary
for the
health and safety
of the mare and/or foal. All
veterinarian and farrier expenses will be paid by the Mare
Owner.
4.
The mare
shall be in good health and sound breeding condition, free from infections,
contagious or transmissible
disease. A current negative Coggins Test,
veterinarian’s health certificate and a copy of the
registration
papers (both sides)
must accompany the mare. If they do
not, Breeder’s veterinarian will examine and/or test
at Mare Owner’s
expense. All Mares must be Halter
Broke and can not have hind shoes on for breeding. Any
mare coming in
with hind shoes on will have them removed at the Mare Owner’s expense. Breeder reserves the
right to refuse to
breed any mares deemed unmanageable and/or unsafe or in poor physical
condition.
5.
Breeder
agrees to diligently try to settle mare; however, if mare fails to settle, for
any reason, Mare Owner will
hold Breeder
harmless. Mare Owner agrees to give
Breeder ample opportunity to settle mare.
6.
The
contract contains a “Live Foal Guarantee.”
A live foal described as a newborn foal which
stands
and nurses
without assistance, within 24 hours of birth. If foal is born dead, there are return
privileges only
if Breeder is
notified within 30 days along with a veterinarian’s statement confirming
death. A
“Breeder’s
Certificate”
will be issued for the foal, conceived by this mating, when stallion fee and all
other expenses are paid in full and when mare had produced a Live Foal by this
mating.

7.
Both
parties agree that Lucky Acres Quarter Horses and any person associated with
Breeder is not liable for
death, sickness
and/or accident including consequential damages caused to the mare and/or foal;
and that the Mare Owner is not liable for death, sickness and/or consequential
damages caused to the stallion. Lucky Acres does not care insurance for
outside/boarded horses.
8.
It is
further agreed that should the above stallion die, be sold by the owner or
become unfit for service, or if the
Mare dies or
becomes unfit to breed before being pronounced safe in foal, the Mare Owner
would have the choice of either the Return of the Stallion Fee (less the $100.00
booking fee) or bringing another mare in her place.
9.
This
contract is non-assignable and non-transferable, unless agreed upon by both
parties. In the event the mare
is sold or
otherwise disposed of prior to the birth of the foal, the “Live Foal Guarantee”
will no longer be valid.
10.
Lucky Acres
Quarter Horses shall have possessory lien on mare for all unpaid bills. Mare Owner shall be
responsible for
reasonable attorney’s fees and court costs if necessary to collect fees due
hereunder.
11.
If Stallion
Service is purchased through a Stallion Service Auction, the mare owner is
responsible for collection,
shipping and extra
chute fees or mare care, Other
guarantees of the SSA contract will be provided by the
committee of the
auction.
12.
This
contract represents the entire agreement between both parties, verbal or
implied, are included unless
specifically stated in
this written contract.
WHEN MARE OWNER AND BREEDER SIGN THIS
CONTRACT, THIS CONTRACT WILL THEN
BE A BINDING CONTRACT,
SUBJECT TO THE ABOVE TERMS AND CONDITIONS.
