Contract for the Breeding Season of
________ is made and entered into on this

between LUCKY ACRES QUARTER HORSES,
herein after designated Breeder, and
_________________________________________,
herein after designated Mare Owner. Mare Owner agrees to breed mare
named
__________________________________,

to the stallion “JULES
FOURTEEN KARAT,” AQHA Registration Number 3898967
for a Live Foal, subject to the following
conditions:__________________________

1.
Stallion Fee includes a non-refundable booking fee of $100.00, payable
with this contract. Semen must not be
used to attempt to impregnate a mare other than the one described in this
contract without prior consent of
the Stallion Owner. A copy of the mare’s registration papers must
accompany this contract to verify the mare
to be bred.
2.
Mare owner must obtain (and pay for) all necessary permits for all
applicable breeding registries in a timely manner. Stallion owner is responsible for all
stallion permits.
3.
AQHA RULES:
a.
Semen must be used within 72
hours.
Mare Owner
must complete portion of the collection & insemination form and return the
copy to AQHA
within 15 days of insemination.
b.
Breeders certificate will NOT be issued until
collection-insemination certificate is completed
and returned
to the Stallion Owner.
c.
Foal resulting from this artificial insemination must
have it’s pedigree verified by genetic testing,
All expenses
of which will be at the expense of the Mare Owner.
4.
Stallion owner shall give at least 7 days ADVANCE notice before
ANTICIPATED date of shipment.
Stallion
Owner MUST be
notified by
Collections
will be done on Saturdays or Sundays, unless agreed upon in advance.
5.
The First Shipment charge is __________ for two vials for two
inseminations. Charge stated
includes collection
and shipping.
Shipping fees are on a PER TIME
basis. Collection and
Shipping will be done by veterinarian and will be at their stated fee. Mare Owner must return the semen
container to the Stallion Owner within 3 days,
and at the
Mare Owner’s expense.

6.
This contract contains a “Live Foal Guarantee.” A live foal described as a newborn foal
which stands
and nurses
without assistance, within 24 hours of birth. If foal is born dead, there are return
privileges only
if Breeder is
notified within 30 days along with a veterinarian’s statement confirming
death. A
“Breeder’s
Certificate”
will be issued for the foal, conceived by this mating, when stallion fee and all
other expenses
are paid in
full and when the mare had produced a Live Foal by this mating. If Mare fails to produce a live
foal,
then same
mare is or a substitute-approved mare will be entitled to a free (excluding
collection and shipping
charges)
breeding the following year only as long as all the provisions in the contract
are met. Different
mares
may be used
for re-breeding when stallion owner is informed and both parties
agree.
7.
It is further agreed that should the above stallion die, be sold by the
owner or become unfit for service, or if the
mare dies or
becomes unfit to breed before being pronounced safe in foal, the Mare Owner
would have the
choice of the
Return of the Stallion Fee (less the $100.00 booking fee) or bringing another
mare in her place.
8.
The mare owner shall bear all loss or risk to their mare, whether by
death, disease, injury, infection or
otherwise and by any cause whatsoever, and therefore releases Lucky Acres
Quarter Horses and Rose and
Mike Motelet harmless for any and all damages associated with the semen
collection, insemination and
subsequent breeding of said mare.
Lucky Acres does not carry insurance for outside/boarded
horses.
9.
This contract is non-assignable and non-transferable, unless agreed upon
by both parties. In the event the
Mare is sold
or otherwise disposed of prior to the birth of the foal, the “Live Foal
Guarantee” will no longer
be
valid.
10. Lucky Acres
Quarter Horses shall have possessory lien on mare for all unpaid bills. Mare Owner shall
be
responsible for
reasonable attorney’s fees and court costs if necessary to collect fees due
hereunder.
11. If Stallion
Service is purchased through a Stallion Service Auction, the mare owner is
responsible for collection,
shipping and extra chute fees or mare care. Other guarantees of the SSA contract
will be provided by the
committee of the auction.
12. This
contract represents the entire agreement between both parties, verbal or
implied, are included unless
specifically stated in this written contract.
WHEN MARE OWNER AND BREEDER SIGN THIS
CONTRACT, THIS CONTRACT WILL THEN
BE A BINDING CONTRACT,
SUBJECT TO THE ABOVE TERMS AND CONDITIONS.
